Occupational Safety and Health Act of 1970 Public Law 91-596, 91st Congress, S.2193, December 29, 1970.

To assure safe and healthful working conditions for working men and women; by
authorizing enforcement of the standards developed under the Act; by assisting and
encouraging the States in their efforts to assure safe and healthful working
conditions; by providing for research, information, education, and training in the
field of occupational safety and health; and for other purposes.
Be it enacted by the Senate and House of Representatives of the United States of
America in Congress assembled, that this Act may be cited as the "Occupational
Safety and Health Act of 1970."
The mission of the Occupational Safety and Health Administration (OSHA) is to save
lives, prevent injuries and protect the health of America's workers. To accomplish
this, federal and state governments must work in partnership with the more than 100
million working men and women and their six and a half million employers who are
covered by the Occupational Safety and Health Act of 1970
Section 5(a)(1) of the Occupational Safety and Health Act of 1970 requires that every
working man and woman must be provided with a safe and healthful workplace. The
section specifically states:
"Each employer shall furnish to each of his employees employment and a place of
employment which is free from recognized hazards that are causing or are likely to
cause death or serious physical harm to his employees."
This statement means that an employer is obligated to protect employees from
recognized hazards in the workplace even if there is not an OSHA standard that
applies to the situation or if hazards still exist after compliance with a standard. The
standard obligates employers to take additional steps toward safety if the well-being
of employees is in jeopardy.
